The NeuroHealth Team refreshed and sharpened our knowledge of the Mental Capacity Act & Court Authorised Deprivations of Liberty this week, through an excellent two-half-day training course provided by St Thomas Training and facilitated by the highly experienced and knowledgeable Robert Corteen. We were expertly guided through the framework of the MCA whilst taking an in-depth look at assessing capacity, fluctuating and temporary capacity, and the best interests process, through the lens of working with vulnerable individuals who have sustained life-changing injuries. We peeled back the “onion of capacity” and considered through extensive discussion, case studies and case law, the key considerations and issues, as well as some common misconceptions and improper practice when implementing the MCA. We also covered the importance of Community DoLS for individuals who are cared for in their own homes that meet the requirements of the Acid Test, and how to ensure that responsibilities and obligations within the DoLS process are upheld.
A big thank you to St Thomas Training and Robert for breaking down what can at times be quite a confusing and complex subject matter into easy-to-understand practical segments. The team left the training sessions feeling energised and empowered to ensure that the rights, wishes and personal choices of our clients are always at the centre of how we work and that we continue to be vigilant in safeguarding these.
